Terms of Service

These Terms of Service ("Terms") form a binding contract between you and Casamigo AS ("Casamigo", "we") and govern your use of the Casamigo mobile application and website ("the Service"). By creating an account, you accept these Terms.

1. What Casamigo is

Casamigo is an online marketplace. We connect homeowners ("Homeowners") looking for home-service work with independent professionals ("Providers") who offer such services. Casamigo is not the provider, seller, or supplier of the services advertised. The contract for any service is concluded directly between the Homeowner and the Provider; the Provider acts in their own name and on their own account as the seller of the service.

Casamigo acts solely as an intermediary in the name and on behalf of others (en nombre ajeno): we present the Provider to the Homeowner as the seller and facilitate the conclusion of their contract, handle payment, and offer dispute-resolution tools. Casamigo does not sell the service, does not resell it in its own name, and gives no guarantee or warranty as to the service itself or its result — responsibility for the service lies with the Provider alone.

2. Eligibility

  • You must be at least 18 years old and able to enter legally binding contracts in Spain.
  • Providers must be legally authorised to carry out the services they offer — typically as autónomo (self-employed) or through a registered company — and compliant with Spanish tax and social security obligations.
  • You may not use the Service if you are on any sanctions list or if your account was previously terminated for a serious breach.

3. Account registration

You must provide accurate information when creating an account and keep it up to date. You are responsible for all activity under your account and for keeping your password safe. Notify us at support@casamigo.app of any suspected unauthorised access.

4. How jobs work

  1. A Homeowner posts a job describing the work.
  2. Providers submit bids with price and estimated time.
  3. The Homeowner accepts one bid. This forms a contract directly between Homeowner and Provider, on the price and scope they agreed.
  4. Payment is held by our payment partner (Stripe) until the job is confirmed complete.
  5. The Provider checks in at the job site and completes the work.
  6. Both parties review the result. Payment is released to the Provider upon Homeowner confirmation, or automatically after 24 hours.

For selected services (such as cleaning and pool care), a Homeowner may also book a Provider directly at a fixed price the Provider has set, without the bidding process in the steps above. The same payment, cancellation, fee, and dispute terms apply. The fixed price is an estimate based on the size or type of property you enter; the Provider may adjust it on arrival to reflect the actual scope of the work, and you can decline before the work begins.

5. Payments, fees and taxes

  • Homeowners pay the agreed price plus a tiered service fee, applied marginally per price band: 5% up to €2,000, 4% from €2,000–€5,000, 3% from €5,000–€15,000, and 2% above €15,000.
  • Providers receive the agreed price minus a tiered commission, applied marginally per price band: 13% up to €2,000, 10% from €2,000–€5,000, 7% from €5,000–€15,000, and 5% above €15,000.
  • The commission percentages are stated excluding VAT. A Provider registered with the Spanish tax authorities (as autónomo or company) accounts for the VAT on Casamigo's commission under the reverse-charge mechanism, and Casamigo adds no VAT. Where no tax registration is on file, Casamigo is required to add Spanish VAT to the commission until the registration is provided. The exact amount deducted is always itemised before the Provider commits to a job.
  • All payments are processed by Stripe. Casamigo never sees your card details.
  • Providers are responsible for declaring and paying Spanish VAT (IVA) and income tax on their earnings. Casamigo transmits payout information to EU tax authorities under DAC7.
  • The Provider issues their own legal invoice (factura) for the service directly to the Homeowner, under the Provider's own tax ID and through the Provider's own invoicing system. This is the Provider's sole responsibility. Casamigo does not generate, issue, or submit the Provider's service invoice, and is not a party to it.
  • For the total amount paid through the platform, the Homeowner receives a Casamigo receipt — a payment summary, not a VAT invoice. The VAT invoice for the service itself comes from the Provider.
  • Casamigo invoices only its own income — its commission and service fee — and accounts for VAT on those fees through the EU One-Stop-Shop (OSS) scheme.
  • Prices shown include VAT where applicable.

6. Cancellation and refunds

A full Cancellation Policy is available in the app at booking time. The following principles apply when a Homeowner cancels a paid booking:

  • More than 24 h before start: full refund to the Homeowner, including the Casamigo service fee. Funds return to the original card within 5–10 business days (Stripe processes the refund).
  • Between 2 h and 24 h before start: the Homeowner receives a 75 % refund of the job price. The remaining 25 % is paid to the Provider as compensation for the late cancellation. The Casamigo service fee is non-refundable in this tier — it covers payment processing, escrow, and dispute mediation infrastructure.
  • Less than 2 h before start: no refund. The Provider keeps the full amount as compensation for the confirmed booking.
  • Provider cancels: the Homeowner receives a full refund including the service fee. Repeated provider cancellations may lead to account suspension.
  • Provider no-show: the Homeowner can raise a claim 30 minutes after the booked time (or at 22:00 on the scheduled day for flexible-time bookings). After a 15-minute response window for the Provider to justify presence, the booking is cancelled and fully refunded.
  • Right of withdrawal (Spanish consumer law): as a consumer you have a 14-day right of withdrawal from the day of booking. If you withdraw before the service has started, you receive a full refund, including the service fee. To exercise it, use the form and instructions at casamigo.app/desistimiento. Ordinary in-app cancellations follow the cancellation policy above.

Casamigo reserves the right to issue discretionary refunds outside this policy — for example, in disputes where our mediation team finds in favour of the Homeowner, or where the failure is attributable to Casamigo (technical issues, incorrect matching, etc.).

7. Disputes

If you are not satisfied with a completed job, you may open a dispute within 24 hours of completion. Casamigo reviews the evidence — photos, GPS check-in, chat history — and may issue a partial or full refund at our reasonable discretion. Our decision is based on the available evidence and our published policies.

8. User conduct

You agree not to:

  • Use the Service for anything illegal.
  • Circumvent our payment system to avoid fees.
  • Harass, threaten, or discriminate against other users.
  • Post false, misleading, or defamatory content.
  • Scrape, copy, or reverse-engineer the Service.
  • Create multiple accounts to evade a suspension.

Breach of these rules may lead to immediate account suspension and forfeiture of pending payouts to the extent permitted by law.

9. Provider obligations

  • Perform work diligently, safely, and in accordance with applicable laws.
  • Hold all required licences, permits, and insurance for the services offered.
  • Declare income and pay taxes in Spain correctly.
  • Respect Homeowners' property and privacy.
  • Complete the Stripe identity verification before receiving payouts.

10. Ratings and reviews

Both parties may leave a rating and written review after a job. Reviews must be honest, based on actual experience, and not contain personal attacks, hate speech, or revealing personal data of the other party. We may remove reviews that violate these rules.

11. Automatic translation

Casamigo provides automatic translation of chat messages and job descriptions using Google Cloud Translation to help users who speak different languages communicate. Translations are generated by machine and may not be perfectly accurate. Casamigo does not guarantee the correctness of any translation. For important details — such as pricing, schedules, or specific instructions — users should verify directly with the other party. You can always view the original text alongside the translation in the app.

12. Content and intellectual property

You retain ownership of the content you upload (photos, descriptions, messages). You grant Casamigo a worldwide, non-exclusive, royalty-free licence to host, display, and use that content as necessary to operate the Service. The Casamigo name, logo, and software are our property.

13. Limitation of liability

Casamigo provides the Service on an "as is" basis. We do not warrant the quality of work performed by Providers or the behaviour of Homeowners. To the maximum extent permitted by Spanish law, Casamigo is not liable for indirect, consequential, or special damages. Our total liability to you is limited to the greater of (a) the fees you paid us in the past 12 months, or (b) €100. Nothing in these Terms limits liability that cannot be limited under Spanish law (e.g. for death, personal injury caused by our negligence, or fraud).

14. Indemnification

You agree to indemnify Casamigo against claims arising from your breach of these Terms, your violation of law, or your interactions with other users.

15. Termination

You may close your account at any time from your profile. We may suspend or terminate your access for serious breach, fraud, or where required by law. Pending bookings and obligations survive termination.

16. Governing law and jurisdiction

These Terms are governed by Spanish law. Consumer Users may bring claims in the court where they reside. Business Users (Providers acting in their professional capacity) agree to the exclusive jurisdiction of the courts of Madrid, Spain.

17. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced in the app and by email at least 30 days before taking effect, except where a shorter period is required by law, to address an unforeseen and imminent danger (security, fraud or data protection), or where the change benefits you. If you do not agree with a change, you may terminate your use of the Service — professionals may terminate the relationship before the change takes effect. Continued use of the Service after the effective date means you accept the new Terms.

19. For professionals (business users)

This section applies to providers and companies offering services through Casamigo, in addition to the rest of these Terms (Regulation (EU) 2019/1150, "P2B").

  • Ranking. The order in which jobs, bids and provider profiles appear is determined mainly by: distance between the property and your service area; whether your profile is complete and identity-verified (Stripe onboarding completed); your average rating and number of completed jobs; and recency of the posting or bid. Price is set by you in your bid and is shown to the customer, but a higher or lower price does not buy a better position. There is no paid ranking and no possibility to pay for improved placement.
  • Differentiated treatment. Casamigo does not offer its own competing services on the platform and does not give any business user — including any business connected to Casamigo — preferential access to ranking, data or platform features.
  • Distribution channels.Your offers are shown only on Casamigo's own app and website. We do not currently market your offers through affiliate programmes or other channels; if that changes, these Terms will be updated with 30 days' notice.
  • Access to data. While you use the Service you have access to: your own profile, bid, booking, review, invoicing and accounting data (Contabilidad and the data export); and aggregated, non-identifying statistics about your own performance. You do not receive personal data of customers beyond what is needed to perform a booked job. After termination, you keep the data export you can download at any time; we retain transactional records as described in the Privacy Policy and provide them on request where the law requires.
  • Intellectual property after termination. Content you uploaded (portfolio photos, profile texts) is deleted or anonymised when your account is deleted, except where retention is legally required. Casamigo claims no ownership of your content and no licence survives termination beyond what is needed for retained transactional records.
  • No circumvention clause — why. Bookings initiated on Casamigo must be paid through Casamigo. This is what funds the platform (our commission is only charged on platform bookings) and what makes escrow protection, invoicing and dispute handling work for both sides. Outside the platform you are free to work with any customer you did not meet through Casamigo, on any terms.
  • Restrictions, suspension and termination.If we restrict, suspend or terminate your account or content, you receive a statement of the specific facts and the grounds (section 20), on a durable medium, before or at the moment the restriction takes effect — and at least 30 days before a full termination, except in the cases P2B art. 4(4) allows (legal obligation, repeated infringement, or imminent harm). Suspension is not final until you have had the opportunity to respond via Support ("Appeal a platform decision"), where a human reviews the case.

20. Moderation and illegal content

Casamigo hosts content posted by users (job posts, bids, reviews, messages, photos). This section describes how we moderate it (Regulation (EU) 2022/2065, "DSA", art. 14).

  • What we use. Automated filters block a limited list of clearly abusive content at posting time, and contact details in chat are automatically masked before a booking exists (this protects the escrow model). Human admins review reported content and are the only ones who can remove content or suspend accounts — no account restriction is decided solely by automation.
  • Notice and action. Anyone — with or without an account — can report content they believe is illegal at casamigo.app/report or by email to illegal-content@casamigo.app. We confirm receipt, review the notice, act without undue delay and tell you the outcome.
  • Statement of reasons. If your content is removed or restricted, or your account is suspended, you receive the specific facts, the legal or contractual ground, whether automation was involved, and how to appeal.
  • Appeal.Open Support and choose "Appeal a platform decision". A human who did not take the original decision reviews it and replies with reasons.
